1. Booking and Payment
1.1 All bookings are subject to availability and confirmed only upon receipt of a deposit of 2,000 THB or full payment.1.2 The remaining balance must be paid prior to the start of the course or dive trip.
1.3 Payments can be made via cash, credit card, or bank transfer, as accepted by the Company.
1.4 The Company reserves the right to refuse participation if payment has not been received in full.
2. Cancellations and Refunds
2.1 Cancellations made more than 30 days before the activity start date will receive a full refund, less any administrative or bank charges.2.2 Cancellations made within 7 days are non-refundable.
2.3 No refund will be issued for late arrivals, no-shows, or unused portions of any course or dive trip.
2.4 In the event that the Company cancels a course or dive due to weather conditions, safety concerns, or operational reasons, the Customer will be offered a full refund or alternative date.
2.5 Refunds will be made using the same payment method as the original booking unless otherwise agreed.
3. Health and Fitness to Dive
3.1 The Customer must be medically fit to dive and will be required to complete a medical declaration form prior to participating.3.2 The Customer must disclose any pre-existing medical conditions or medications that may affect diving safety.
3.3 If any doubt arises, the Customer must obtain a medical certificate from a qualified physician before participating.
3.4 The Company reserves the right to refuse participation to anyone deemed medically unfit to dive, without refund.
4. Certification and Experience
4.1 The Customer must present valid proof of certification (e.g., PADI, SSI, NAUI) before joining any certified dive.4.2 The Company may require the Customer to complete a refresher dive if the last recorded dive was more than 6 months ago.
4.3 For beginners or non-certified divers, participation in introductory programs is allowed under instructor supervision.
5. Safety and Conduct
5.1 The Customer agrees to follow all instructions given by instructors, divemasters, or guides employed by the Company.5.2 The use of alcohol, drugs, or any intoxicating substances before or during diving activities is strictly prohibited.
5.3 The Company reserves the right to exclude any Customer whose behavior is unsafe, disruptive, or disrespectful to others.
5.4 The Customer must use all dive equipment responsibly and report any defects or malfunctions immediately.
6. Equipment
6.1 The Company provides diving equipment in safe and serviceable condition.6.2 The Customer is responsible for the care and return of all rental equipment.
6.3 The Customer agrees to compensate the Company for any loss or damage to equipment caused by negligence or misuse.
7. Liability and Insurance
7.1 The Customer acknowledges that diving carries inherent risks, including but not limited to decompression illness, drowning, and marine life injuries.7.2 The Company, its employees, and agents shall not be held liable for any loss, injury, damage, or death arising from participation in diving activities, except where caused by proven negligence.
7.3 The Customer is strongly advised to obtain personal travel and dive insurance covering diving-related incidents, medical expenses, and evacuation.
7.4 The Customer participates entirely at their own risk.
8. Personal Belongings
8.1 The Company accepts no responsibility for the loss, theft, or damage of personal belongings on its premises, boats, or vehicles.8.2 Customers are advised not to bring valuables during diving activities.
9. Media and Promotion
9.1 The Customer agrees that the Company may take photos or videos during activities for marketing or promotional purposes.9.2 If the Customer does not wish to appear in such media, they must notify the Company in writing before participation.
10. Governing Law
10.1 This Agreement shall be governed by and construed in accordance with the laws of Thailand.10.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Suratthani, Thailand.
